Judge Denies Motion for a Preliminary Injunction in Mask Mandate Ban Case

A Miami federal judge has delivered a blow to a group of children with disabilities and their parents who sued the Governor over the student mask mandate ban. In denying a motion for a preliminary injunction, the judge ruled the plaintiffs were not likely to succeed on the merits because they have failed to exhaust their claims under the Individuals with Disabilities Education Act.

They argued without a mask mandate at schools, children with disabilities, who have a higher chance of developing severe cases of COVID, could not attend classes, which is a violation of the Americans with Disabilities Act. Attorneys for the children are evaluating their options on whether to appeal.
